Who these terms are with

GutStamp is provided by Srikumar Ramanan, trading as Zoryvix, a sole trader in Australia, ABN 16350546513. In these terms, "we", "us" and "our" mean that sole trader, and "you" means the person using the app.

By downloading or using GutStamp you agree to these terms. If you do not agree, do not use the app.

What GutStamp is

GutStamp gives you dietary information, not medical advice. It estimates the FODMAP content of meals, menu items and packaged foods from published research, and it guides you through an elimination, reintroduction and personalisation program so you can work out which FODMAP groups affect you.

What GutStamp is not

• It does not diagnose, treat or cure IBS or any other condition, and nothing in the app should be read as claiming otherwise.
• It is not for allergy or anaphylaxis decisions. Always confirm ingredients directly with restaurant staff or the product manufacturer if you have an allergy.
• It is not a substitute for advice from your doctor or an accredited dietitian.

Accuracy, and the limits of a scan

A scan is an estimate. It works from a photograph or a description, and from a food database with known gaps. It can misread a photo, miss an ingredient that is not visible or not printed, misjudge a portion size, or have no data for a food at all. Menu results are based on how a dish is typically prepared, not on what a particular kitchen actually does.

You should treat every verdict as a starting point for your own judgement, not as a guarantee about a particular plate of food.

Who can use GutStamp

You must be at least 17 years old to use GutStamp. It is not designed for children.

You do not create an account. There is no sign-in, no password, and nothing for you to lose access to if you change device, beyond restoring your subscription as described below.

Subscriptions

GutStamp requires a paid subscription. There is no free tier.

The plans. As at the date of these terms:

• Annual — A$59.99 per year, including a 7-day free trial for new subscribers.
• Weekly — A$8.99 per week, with no free trial.

The price shown to you in the app before you confirm, and again by Apple at the moment of purchase, is the price that applies. Prices are set per storefront and may differ from the amounts above in your currency or region.

Free trial. If you start the annual plan with a free trial, you get full access for 7 days at no charge. If you do not cancel at least 24 hours before the trial ends, the trial converts to a paid annual subscription and your Apple account is charged. Any unused portion of a free trial is forfeited if you buy a subscription before the trial ends.

Auto-renewal. Subscriptions renew automatically. Your Apple account is charged for the next period within 24 hours before the current period ends, at the then-current price for your plan, unless you turn off auto-renewal at least 24 hours before that.

Cancelling. You can turn off auto-renewal at any time in your Apple account settings, under Subscriptions. Settings in the app links you there. Cancelling stops future charges; your access continues until the end of the period you have already paid for. We cannot cancel your subscription for you — Apple controls it, not us.

Payment and billing. Apple is the seller of record for in-app purchases. Payment is taken by Apple through your Apple account, under Apple's own terms. We never see or handle your payment details.

Price changes. If we change the price of a plan, Apple will tell you and ask for your consent before the new price applies to your renewal, as Apple's rules require.

Your consumer rights

In Australia. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under that law, and if any part of these terms would do so, it does not apply to you to that extent.

For a major failure with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem fixed in a reasonable time, and if that is not done, to cancel your contract and obtain a refund for the unused portion.

In New Zealand. Where you acquire GutStamp as a consumer, the guarantees in the Consumer Guarantees Act 1993 apply and cannot be contracted out of. Nothing in these terms limits your rights under that Act or under the Fair Trading Act 1986.

How to ask for a refund. Because Apple processes the payment, refund requests normally go to Apple, through the "Report a Problem" page on Apple's website or your Apple account's purchase history. Apple decides those requests under its own policy, and we are not able to issue a refund through the App Store ourselves. This does not take away your rights above. If Apple declines and you believe you are entitled to a remedy under the Australian Consumer Law or the Consumer Guarantees Act, contact us at hello@gutstamp.com and we will deal with your claim directly.

How you may use GutStamp

You may use GutStamp for your own personal, non-commercial use. You agree not to:

• use it to make allergy or anaphylaxis decisions, for yourself or anyone else;
• present its output as medical, dietetic or clinical advice, to yourself or anyone else;
• copy, scrape, resell or redistribute our food database, verdicts or program content;
• attempt to bypass the subscription, interfere with our servers, or submit automated or bulk scans; or
• upload content you have no right to submit, or anything unlawful.

We may suspend access if the app is being used in a way that breaks these rules or threatens the service for others.

Our content

The app, its food database, its program content, its wording and its design belong to us or to our licensors. These terms do not transfer any of that to you. Photographs and text you submit for a scan remain yours; you give us permission to process them only to produce your verdict, as described in the Privacy Policy.

Food composition figures in our database are derived from published, peer-reviewed research. We are not affiliated with, endorsed by or certified by any university, research group or health organisation.

Availability and changes

We may change, suspend or withdraw features, and we may update the food database and program content. We will not intentionally remove the core functionality you have paid for during a period you have already paid for. The app needs an internet connection to scan; we do not guarantee uninterrupted or error-free operation.

If we change these terms, we will update the date at the top and publish the new version in the app and on our website. Changes are not retrospective.

Our liability

Nothing in this section limits your rights under the Australian Consumer Law, the Consumer Guarantees Act 1993, or any other law that cannot be contracted out of.

Subject to that, and to the fullest extent the law allows, we are not liable for any loss arising from your reliance on a verdict, a swap suggestion, a safe-serve figure, or any other dietary information in the app.

Ending these terms

You can stop using GutStamp at any time by cancelling your subscription with Apple and deleting the app. We can end your access if you materially breach these terms. Ending access does not by itself entitle you to a refund, except where your consumer rights above say otherwise.
